Terms & Conditions
1) I appoint and authorise south coast relocation services ltd for a period of 3 months from the date of this contract to act as my sole agents in searching for a property to purchase or, as the case may be, to rent on the terms below.
2) south coast relocation services ltd agrees to use its reasonable endeavours to find a suitable property to purchase or, as the case may be, to rent in accordance with the specification and criteria provided by me. I acknowledge that the choice of property is my responsibility.
3) In respect of this appointment, I agree to pay a non refundable deposit fee of £300.00
4) I will pay south coast relocation services ltd a commission fee equal to 1.25% of the purchase price excluding agent's fees and stamp duty on completion of a contract for purchase of a property:
4.1) with a vendor introduced by south coast relocation ltd in the period of its sole agency, or with whom we had negotiations concerning the property during that period
Property Rental Searches
5) I will pay to south coast relocation ltd a commission fee equivalent to one month's rent excluding agent's fees on exchange of a tenancy agreement:
5.1 with a landlord introduced by south coast relocation ltd in the period of its sole agency, or with whom we had negotiations concerning the property during that period; or
5.2 with a landlord found by me or introduced by another agent or someone else during the period of our sole agency, whether or not south coast relocation ltd had negotiations.
The initial deposit fee of £300.00 will be deducted from the commission fee.
General
6) Fees stated in this contract are exclusive of any applicable VAT which shall be payable by me subject to receipt of a VAT invoice. No VAT is currently charged.
7) A property or vendor will be deemed to have been introduced by south coast relocation ltd if I have, during the search period, received details of such property or vendor from south coast relocation services ltd.
8) I agree that, if south coast relocation services ltd considers that it may assist in the search for a property, it may instruct or seek at no additional cost to me (unless agreed otherwise by me in writing) the cooperation of other intermediaries or agents. I will be liable to pay fees to south coast relocation services ltd only.
9) All information and particulars of property provided by south coast relocation services ltd are for the purposes of guidance only and do not form part of the contract between us.
10) south coast relocation services ltd shall not be responsible for any indirect or consequential loss or damage (whether loss of profit or otherwise) or any damage of any other nature in excess of £15,000, costs or expenses, nor shall south coast relocation ltd be liable for any claims for consequential compensation, which arise out of or in connection with any property or this contract. This paragraph does not affect claims in respect of death or personal injury caused by the negligence of all property solutions and does not limit or excluded any liability for fraudulent misrepresentation.
11) south coast relocation services ltd has advised me to take my own professional advice and to use the services of solicitors, surveyors, valuers, financial advisers or providers and other specialist as necessary, for whose fees I am solely responsible, even if such parties have been introduced by all property solutions. south coast relocation ltd accepts no liability for defects in relation to any property, availability of finance or advice received.
12) I agree to indemnify south coast relocation services ltd for any reasonable sum incurred on my behalf and for any loss or costs or expenses incurred or suffer by south coast relocation services ltd as a result of any act, omission, delay or representation made by me or on my behalf, or in relation to any false or erroneous information provided by me.
13) If I exchange contracts for the purchase of a property or enter into a tenancy agreement in respect of a property originally introduced by south coast relocation services ltd within 12 months of the date of this contract then the full fee as agreed (less the deposit) will apply.
14) None of the terms of this contract will be enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person that is not a party to it.
Data Protection
15) I understand and agree that south coast relocation services ltd may use my personal information provided during the period of its sole agency for property searches and acquisitions, independent mortgage and financial advice, arranging local and national advertising, arranging viewings, help and advice to completion, advertising on the internet, negotiations with potential vendors, instructing solicitors on agreed purchase and arranging surveys and valuations. south coast relocation services ltd may disclose my information to vendors and to other intermediaries or agents for these purposes. South coast relocation services ltd may keep my information for a reasonable period and may contact me about services in the future. If I do not wish south coast relocation services ltd to do this, I am entitled to write to them accordingly.
16) I have a right to ask for a copy of my information and to correct any inaccuracies in the data.
17) This contract shall be governed by English law and the parties submit to the exclusive jurisdiction of the English court.
